Terms of Service
These terms are a binding agreement between you and Xevra ("Xevra", "we", "us"). By inviting our bot to a Discord server, using our dashboard, or subscribing to Premium, you accept them. If you do not accept them, do not use the Service.
1. The service
Xevra provides a Discord bot, a web dashboard at https://xevra.org, and related software tools for Discord communities. This includes moderation, ticketing, automated content filtering, security and anti-raid protection, leveling, welcome messages, notifications and other features we may add, remove or change over time (together, the "Service").
We offer the Service on a free tier and a paid Premium tier. We may modify, suspend or discontinue any part of the Service. Where a change materially reduces a paid feature you are actively using, we will give reasonable notice.
2. Relationship to Discord
Xevrais not created by, affiliated with, endorsed by or sponsored by Discord Inc. Your use of Discord is governed by Discord's own Terms of Service, Community Guidelines and Developer Policy. Nothing here overrides them, and we cannot grant you rights on Discord's platform that Discord does not.
3. Eligibility and your account
You must meet Discord's minimum age requirement for your country to use the Service. To configure a Discord server through our dashboard you must hold the Manage Server permission in that server. We sign you in through Discord; we never receive or store your Discord password.
4. Your responsibilities
You are responsible for how the Service is used in servers you control. You agree not to:
- use the Service to break Discord's Terms of Service, Community Guidelines or Developer Policy, or any applicable law;
- use the Service to harass, threaten or defame others, or to distribute malware, spam, or content that sexualises minors;
- attempt to reverse-engineer, decompile, scrape, overload, evade rate limits on, or gain unauthorised access to the Service or its infrastructure;
- resell, sublicense or rent access to the Service, or extend Premium entitlements to servers that have not paid for them;
- use the Service to process personal data unlawfully, including configuring logging in ways that breach your members' privacy rights.
You are responsible for what your server's moderators do with the tools we provide, including automated punishments you configure.
5. Payments and subscriptions
Premium costs £4.99 / month per server and is billed per Discord server. Payments are processed by Stripe; we never receive or store your card details. By subscribing you authorise recurring charges to your payment method.
Subscriptions renew automatically at the then-current price at the end of each billing period until cancelled. If we change the price, we will give notice before it applies to your renewal, and you may cancel before it takes effect. If a payment fails we may retry it, and may suspend Premium features until payment succeeds.
Applicable taxes may be added to the price shown. You are responsible for any taxes arising from your own use of the Service.
6. Cancellation and refunds
You may cancel at any time from your server's billing page or through the Stripe billing portal. Cancellation stops future charges, and Premium features remain available until the end of the period you have already paid for.
Payments are otherwise non-refundable, including for partial billing periods and for periods during which you did not use the Service.
This does not affect any statutory rights you have as a consumer. Consumers in the European Union and the United Kingdom have a right of withdrawal for digital services which may apply regardless of the paragraph above. Where such a right applies, it prevails over these terms.
If you believe you have been charged in error, contact support@xevra.orgbefore raising a chargeback with your bank — it is nearly always faster.
7. Suspension and termination
We may suspend or terminate your access to the Service, with or without notice, if you breach these terms, if we are required to by law or by Discord, or if your use threatens the security, stability or lawful operation of the Service or of other users.
Where we terminate a paid subscription for reasons other than your breach, we will refund the unused portion of the current billing period. Where we terminate for your breach, no refund is due.
You may stop using the Service at any time by cancelling your subscription and removing the bot from your servers.
8. Intellectual property
The Service, including its software, dashboard, name, logo and visual design, is owned by Xevra and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service as intended. No other rights are granted.
Content you supply — server configuration, custom command responses, embed text, uploaded images — remains yours. You grant us the licence necessary to store, process and display that content in order to operate the Service for you.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.
Automated moderation and security features are heuristic. They will sometimes fail to catch abuse and will sometimes act on legitimate activity. They are a tool for your moderation team, not a replacement for it, and should not be your only safeguard.
10. Limitation of liability
To the fullest extent permitted by law, Xevra is not liable for indirect, incidental, special, consequential or punitive damages, nor for loss of data, profits or goodwill, nor for damage arising from server disruption, from moderation decisions made by the Service, or from the Service being unavailable.
Our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or ten Swiss francs.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
11. Privacy and data handling
Our Privacy Policy explains what data the bot and dashboard store, why, who it is shared with, and how to have it deleted. It forms part of these terms.
Where you use the Service to process personal data about your server members — message logs or ticket transcripts, for example — you are responsible for having a lawful basis to do so and for telling your members what you collect.
12. Changes to these terms
We may update these terms. The date at the top of this page shows when they last changed, and continued use of the Service after a change means you accept the updated terms. For material changes affecting paid subscribers, we will give notice before they take effect.
13. Governing law
These terms are governed by the laws of Switzerland, without regard to conflict of law rules. If you are a consumer, you keep the protection of any mandatory provisions of the law of your country of residence, and may bring proceedings there.
